GTC - General Terms and Conditions
1. Scope of Application
These General Terms and Conditions (GTC) apply to all orders, deliveries, and services between Le Noa (hereinafter referred to as "Provider") and the customers (hereinafter referred to as "Customer") via the online shop, direct sales, as well as for offered training and services.
Le Noa develops, produces, and distributes products for professional lash and brow treatments.
Sales are primarily made to commercial customers (B2B) such as studios, trainers, distributors, and beauty professionals. Some products may also be sold to end consumers (B2C).
Deviating conditions of the customer will not be recognized unless their validity has been expressly agreed to in writing.
2. Contractual Partner

3. Prices
All prices are in euros.
Depending on the customer group (B2B or B2C), prices may be displayed including or excluding statutory value-added tax.
In addition to the stated prices, shipping costs may apply. These will be transparently indicated during the ordering process.
For international orders, additional customs fees, taxes, or import costs may apply. These are to be borne by the customer.
4. Delivery and Shipping
Delivery will be made to the delivery address specified by the customer.
The delivery time may vary depending on the product, stock availability, and delivery country. More precise information will be provided during the ordering process or on the product page.
If a product is temporarily unavailable, the customer will be informed.
Le Noa collaborates with international distributors and shipping partners.
5. Payment Terms
The following payment methods may be offered:
Credit card
PayPal
Instant transfer / Online payment
Prepayment
SEPA direct debit mandate
other payment methods offered in the shop
The provider reserves the right to exclude certain payment methods on a case-by-case basis.
6. Retention of Title
The goods remain the property of Le Noa until full payment is received.
For entrepreneurs, the goods remain the property of the provider until all claims from the ongoing business relationship are fully settled.
7. Return and Right of Withdrawal
A right of return or exchange is generally excluded.
An exception applies exclusively to consumers (B2C), provided that a statutory right of withdrawal exists in accordance with the applicable legal provisions.
The right of withdrawal does not exist in particular for:
sealed products that cannot be returned for hygiene reasons after opening
custom-made products
services that have already been fully rendered (e.g. training)

8. Training and Education
Le Noa offers professional training in the field of lash and brow treatments.
By booking a training session, the participant acknowledges the following conditions:
Training spots are reserved bindingly after booking
Cancellations made after 24 hours may incur a charge of 50% of the training fee
In case of no-show without prior cancellation, there is no right to a refund
After successful participation, a certificate can be issued.
9. Warranty and Guarantee
The statutory warranty provisions apply.
A guarantee is not granted by Le Noa, unless expressly agreed in writing.
The customer is obliged to check the delivered products for obvious defects upon receipt and to notify them immediately.
There are statutory liability rights for defects for our goods.
10. Special Notes on the Use of Professional Products
A part of the Le Noa products offered is intended for professional use in the beauty sector, specifically targeting trained lash and brow artists as well as professional studios.
The products are to be used in accordance with the respective application instructions, safety information, and training content.
Le Noa assumes no liability for damages, which arise from:
improper use of the products
use by untrained users
failure to observe safety or application instructions
combination with unsuitable products from other manufacturers
The responsibility for the proper use of the products lies with the user.
10.1. Note on allergies and skin reactions
Before using products in the area of eyelash and eyebrow treatments, it is recommended to conduct a patch test (compatibility test).
Le Noa assumes no liability for individual allergic reactions or intolerances, unless these are due to a product defect.
10.2. Electrical devices
Electrical products with CE marking may only be used in accordance with the respective safety and operating instructions.
The user is obliged to use the devices properly and to comply with the relevant safety regulations.
11. Liability
The provider is only liable for damages that are based on intentional or grossly negligent behavior.
For slight negligence, the provider is only liable in case of violation of essential contractual obligations.
Liability for indirect damages or consequential damages is excluded, as far as legally permissible.
Liability under the Product Liability Act remains unaffected.
12. Data Protection
The processing of personal data is carried out in accordance with the privacy policy on the website.
13. Applicable Law
The law of the Republic of Austria applies, excluding the UN Sales Convention.
14. Final Provisions
Should any provision of these GTC be or become ineffective, the validity of the remaining provisions shall remain unaffected.
15. Resale, Distribution, and Trademark Rights
Resale of the products
The resale of the products from Le Noa is fundamentally intended only for commercial customers who use or distribute the products in the context of their professional or business activities.
Commercial resale through online marketplaces, platforms, or other distribution channels may be restricted or prohibited by Le Noa if necessary to maintain brand integrity or product quality.
Le Noa reserves the right to refuse or discontinue deliveries to dealers or distribution partners if brand guidelines or distribution conditions are violated.
Distribution through distributors
Le Noa works internationally with selected distributors and sales partners.
Distributors can obtain exclusive or non-exclusive distribution rights for specific countries or regions. The respective conditions are regulated in separate distribution agreements.
The distribution of Le Noa products outside the agreed distribution areas may be prohibited.
Trademark Rights
The brand Le Noa, including logos, product designs, images, texts, and brand content, is protected by copyright and trademark law.
The use of the Le Noa brand, especially for advertising purposes, online shops, social media platforms, or other commercial activities, is only permitted with prior written consent from Le Noa.
Unauthorized use of the brand or brand content may result in legal action.
